eCommerce Terms and Conditions
1. Application
1.1. Except where expressly indicated otherwise, these Terms and Conditions apply to all products purchased online from The Shop at Old Parliament House. Please read our Terms and Conditions before completing your order.
1.2. By purchasing products online from The Shop, you agree to be legally bound by our Terms and Conditions.
1.3. MoAD may amend, remove or vary these Terms and Conditions from time to time. Our Terms and Conditions will become current and apply to all products once they are published on this website.
2. Pricing
Pricing and product descriptions
2.1. All prices quoted are in Australian dollars (AUD) and are inclusive of the Goods and Services Tax (GST).
2.2. The Shop accepts the following payment methods: Visa, MasterCard, American Express, JCB, Discover, Diners Club and Apple Pay, in Australian dollars only.
2.3. Payment of the correct price must accompany all orders. MoAD takes all reasonable care to ensure that product details and prices on this website are correct at the time of publication. Product details and prices are subject to change without notice in relation to future sales.
2.4. Sale and promotional product offers are only available at the lower price while the allocation lasts and during the designated sale period. MoAD reserves the right to withdraw any offer at any time.
2.5. Online pricing may differ from prices for identical or equivalent products available in-store in The Shop at Old Parliament House in Canberra, Australia.
3. Ordering
Ordering process
3.1. The sale of all products is subject to availability.
3.2. Orders are placed by filling out the online order form. MoAD can only accept and process orders when the order form is completed and all required information is provided. MoAD will not be responsible for any incomplete information in your customer details.
3.3. Once MoAD has received full payment, customers will receive an automatic email to the email address they have provided in the online order form. MoAD will not be responsible for any errors in details or contact information included in the order form.
Sizing, colouration and imperfections
3.4. Although MoAD endeavours to accurately display sizes and sizing charts, size information is provided as a guide only.
3.5. Although MoAD endeavours to accurately describe and or display product colours, actual product colours may vary slightly online and in real life. This colour variation is not a fault and is not a valid reason for a refund or exchange.
3.6. All product images are published for indicative and illustrative purposes only. MoAD acknowledges that some handmade products or those that contain components made from organic materials may present small imperfections or variations. These will often differ from the product images published online.
4. Delivery
Postage
4.1. The Shop ships orders within Australia only.
4.2. Postage is a flat rate cost of $12.00 per order.
4.3. The Shop uses Australia Post to send orders domestically. The Shop is not liable for any missing orders and is unable to refund orders lost in delivery.
4.4. The Shop will not be responsible for any delay or failure to process customer orders or delivery of products due to inaccurate or incomplete details provided in the online order form.
Delivery timing
4.5. Orders are typically dispatched within five (5) business days of purchase (excluding weekends and public holidays).
4.6. Orders may be delayed due to unexpected demand or restocking issues.
4.7. The Shop will provide a notification email and tracking details after the order is dispatched.
5. Returns, refunds and exchanges
Cancelled orders
5.1. The Shop reserves the right to cancel orders at any time (for example, due to unavailability or an error in the product description). If this occurs, MoAD will contact the customer, via the email address provided in the online order form, to organise a refund or exchange.
Refunds and returns
5.2. MoAD acknowledges that in the event of any misleading or deceptive representation by MoAD, defective product or incorrect order, you have rights under the Australian Consumer Law (ACL). Where the customer has rights under the ACL, MoAD will refund, credit or exchange purchases (including delivery/packaging costs) at its election, unless the customer is entitled to a particular remedy under the ACL.
5.3. MoAD foes not offer refunds for change of mind. However, we may offer an exchange or store credit if an item is returned within 30 days of delivery and is in its original saleable condition and packaging.
The following items are not eligible for a change of mind exchange or credit:
• Sale or discounted items
• Food, beverages and perishable items
• Items that have been used or opened
• Earrings
5.4. Shipping costs are non-refundable. Customers are responsible for the return shipping costs, unless the item is defective for incorrect.
6. Secure payments
6.1. Payment is processed immediately with the online product purchase.
6.2. Payment is processed in Australia dollars only.
6.3. To ensure protection of customer credit card details, credit card payments are processed using a secure, third-party payment gateway service run by Braintree – a PayPal service. Credit card details are encrypted and cannot be accessed by MoAD.
6.4. Details about our secure payment partner, Braintree, can be found on the Braintree website.
6.5. While MoAD contracts with a service provider to provide a secure system, MoAD does not and cannot take responsibility for the security of information during transit over the internet.
7. Personal information
7.1. MoAD uses a third-party provider, Shopify, to collect personal information when a customer purchases products. This information is collected for the purposes of fulfilling the order.
7.2. If the customer opts-in to MoAD newsletters or promotional information, MoAD may disclose their personal information to Campaign Monitor – the third-party provider for MoAD’s e-newsletter distribution. These details will only be used for MoAD newsletters. Campaign Monitor is an online system for creating, delivering and tracking digital communication campaigns.
7.3. MoAD may disclose a customer’s personal information to Australia Post for the purposes of delivering the order.
7.4. MoAD securely retains customer order details to help manage potential returns, refunds and exchanges. MoAD does not retain credit card details in any circumstances.
7.5. MoAD collects and uses customer personal information under the terms of MoAD's Privacy Policy. This Privacy Policy includes details about how the customer can make complaints or access and correct personal information. Customers are encouraged to read MoAD’s Privacy Policy.
8. Liability and law
Exclusion and limitation of liability
8.1. To the extent permitted by law, MoAD excludes all liability to any person for loss or damage of any kind (however caused, including by negligence) in connection with supplying or failing to supply products via The Shop (including due to interruptions to the platform for any reason).
8.2. Where any law imposes a non-excludable guarantee relating to these Terms and Conditions, then to the extent permitted by law, MoAD’s liability for breach of the guarantee will, at MoAD’s election, be limited to re-supplying the purchased products(s), or paying the cost of re-supply.
The governing law is the Australian Capital Territory
8.3. In purchasing products via The Shop, the customer agrees to the laws of the Australian Capital Territory, which govern the terms of the purchase, and the customer submits to the non-exclusive jurisdiction of the courts of the Australian Capital Territory.
